Terms of Service

Overview These Terms of Service (“Terms”) apply to your use of the SodaMarketing.AI online service. If You use it, please use it responsibly. For paid accounts, you’ll be charged on a monthly/annual basis, depending on your plan. You can cancel anytime, but there are no refunds. You own the business data that you provide to SodaMarketing.AI, and You are responsible for keeping it safe. The Terms, the SodaMarketing.AI Service, and our prices can change anytime. We’ll warn you 30 days in advance of any price changes. You must read through the entire document below and agree with all the details before you use any of our sites.

Your Agreement with SodaMarketing.AI These Terms govern your use of the SodaMarketing.AI Service. The “Service” means the services SodaMarketing.AI makes available, including our website (https://sodamarketing.ai/), our blog, our API, and any other software or services offered by SodaMarketing.AI (operated by Pioneers Now Inc).

To use the Service, You must first agree to the Terms. SodaMarketing.AI will treat Your use of the Service as acceptance of the Terms from that point onwards. Your Account

  • You may not use the Service if You are a person barred from receiving the Service under the laws of the United States or other countries, including the country in which You are resident.

  • You must be over the age of 18.

  • Accounts created by automated methods (bots) are not permitted.

Use of the Service

  • You must provide accurate and complete registration information.

  • You are responsible for the security of Your passwords and account use.

  • Your use of the Service must comply with all applicable laws, regulations, and ordinances.

  • SodaMarketing.AI reserves the right to enforce quotas and usage limits at its sole discretion.

Fees for Use of the Service

  • Usage requires Your purchase of resources or services via credit card on a monthly/yearly basis.

  • Payments are non-refundable. There are no refunds or credits for partial months of Service or unused time.

  • All fees are exclusive of taxes, levies, or duties imposed by taxing authorities.

  • SodaMarketing.AI may change its fees by notifying You at least ten (10) days before the beginning of the relevant billing cycle.

Cancellation and Termination

  • You must cancel Your account via a support request at https://sodamarketing.ai/ using your account email.

  • If You cancel before the end of Your current paid-up period, Your cancellation will take effect immediately and You will not be charged again.

  • SodaMarketing.AI, at its sole discretion, may terminate or suspend Your account without prior notice for any violation of these Terms.

License from SodaMarketing.AI and Restrictions All content available through the Service is owned or controlled by SodaMarketing.AI (Pioneers Now Inc) and is protected by copyright, trademark, and patent laws of the United States and international treaties. We grant you a personal, worldwide, royalty-free, non-assignable, and non-exclusive license to use the software for its intended purpose. You may not reverse engineer, decompile, or attempt to extract the source code of the Service.

Disclaimer of Warranties WE PROVIDE THE SERVICE “AS IS”, “WITH ALL FAULTS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE HEREBY DISCLAIM ALL WARRANTIES, INCLUDING ANY WARRANTIES THAT THE SERVICE IS MERCHANTABLE, ACCURATE, OR FIT FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT THE SERVICE WILL OPERATE ERROR-FREE OR THAT LOSS OF DATA WILL NOT OCCUR.

Limitations on Liability YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US IS THE CANCELLATION OF YOUR REGISTRATION. IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT OF FEES YOU PAID TO UTILIZE THE SERVICE OR (B) ONE HUNDRED DOLLARS ($100).

Indemnification You agree to hold harmless and indemnify SodaMarketing.AI and its parent company, Pioneers Now Inc, and their officers, agents, and employees from any third-party claim arising from Your use of the Service or Your violation of applicable laws.

Choice of Law and Dispute Resolution The Terms of Service shall be deemed to have been entered into and shall be construed and enforced in accordance with the laws of the State of Delaware, USA, without giving effect to any conflicts of law statutes. Any controversy, dispute, or claim arising out of or related to the Terms, the Privacy Policy, or the Service shall be settled by final and binding arbitration to be conducted in the State of Delaware. Any disputes shall be resolved individually without resorting to any form of class action.

General Legal Terms The Terms, including the Privacy Policy, constitute the whole legal agreement between You and SodaMarketing.AI (Pioneers Now Inc). If any part of the Terms is held invalid, that portion shall be construed to reflect the original intentions of the parties, and the remaining portions shall remain in full force.
